Official T-Shirt Design Contest Rules
Start date: 06/01/2009-07/31/2009
Prizes: 3rd $100 Gift Certificate.
2nd $150 Gift Certificate.
Grand Prize: $250 Gift Certificate.
Prize will be announced and awarded on the 15 day of the following month according to these Official Rules.
Estimated value of the prize is $500. Substitution for any prize may be necessary due to unavailability, in which case a comparable prize of equal or greater value will be awarded. AXO America, Inc. reserves the right to change these Official Rules, at any time, with or without prior notice.
Eligibility
The ‘T-shirt Design” is open to residents of the 50 United States, Washington, D.C., and Canada. Those contestants under the age of 13 must receive prior parental consent. For more details regarding parental consent please see the Website Terms of Use. Employees of AXO America, Inc. and affiliated companies and members of those employees’ immediate families are not eligible. The chances for winning depends on the total number of entries received. No purchase is necessary to win.
To Enter
To enter you must upload a photo to the contest site (the “Uploaded Content”) by completing the following:
• Visit Axocafe.loopd.com
• You must then select the Photo Contest section and click the “Enter Now” link to initiate the process.
• If you are already a registered member of the Loop’d network you may use your login information to login to the contest upload page. If you are not a member of the Loop’d Network you will be required to register prior to the submission of a photo.
• All photos will be reviewed prior to release to the contest by a site representative.
• Photos should be under 100 megs and must be submitted in one of the following formats: .jpg, .gif, .jpeg, .tiff, .bmp, and .png. All photo content/quality must be clear and decipherable. Any photos containing nudity, foul language, graphic or offensive materials will be rejected.
• Any photo that you submit to the Contest must be specific the Contest. Any photo that is uploaded to the Contest that does not pertain to the Contest subject matter, may be removed and will not be eligible to win a prize
In the event of a dispute over your identity, the Uploaded Content will be deemed submitted by the holder of the e-mail account. AXO America, Inc. is not responsible for technical failures in entry transmission, or lost, late, misdirected, damaged, or incomplete entries. AXO America, Inc. is not responsible for any damage to your computer occasioned by participation in the Contest or downloading any information necessary to participate in the Contest. AXO America, Inc. reserves the right, at its sole discretion, to cancel the Contest if it becomes technically corrupted, and select winners from all eligible entries received before cancellation.
AXO America, Inc. reserves the right to remove any Uploaded Content which, in its sole discretion, is deemed to be inappropriate, offensive, or in violation of these Contest rules. AXO America, Inc. also reserves the right, in its sole discretion to disqualify you in the event you are deemed to have tampered with the entry process or voting process, violated these Contest rules, or have acted in an unsportsmanlike way or disruptive manner with the intent to threaten, harass, abuse, or annoy another person in connection with the Contest.
Entry Conditions
As a condition of entry into this contest and by uploading content to the contest site, you represent and warrant the following regarding your Uploaded Content: (i) the Uploaded Content is original and legally created; (ii) the Uploaded Content does not infringe on intellectual property, privacy or publicity rights or any other legal or moral rights of a third party; (iii) you own all rights to the Uploaded Content, including but not limited to, all copyrights related to the Uploaded Content; (iv) the Uploaded Content has not been entered in or won a previous contest or award; and (v) the Uploaded Content has not been previously published or distributed by the media. You further represent and warrant that you have obtained the express permission from each person whose name, image, likeness, and/or voice may appear in the Uploaded Content to use such person’s name, image likeness, and/or voice, and that, upon AXO America, Inc. request; you are permitted to make copies of the Uploaded Content. If the Uploaded Content contains the name, image, likeness, and/or voice of a minor, such consent must include the written contest of said minor’s parent or legal guardian.
By uploading the Uploaded Content, you irrevocably grant AXO America, Inc. and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, broadcast, post, publish, transmit, display, publicly perform, encode, store, copy, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Uploaded Content, as submitted or as edited/modified in any way by AXO America, Inc. in its sole discretion, as well as to use your name, likeness, photograph, and/or statements regarding your participation in the Contest in any and all media without limitation as to time or territory, and without additional compensation or approval from you or any other party. You hereby waive intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude AXO America, Inc. use of the Uploaded Content, and agree not to assert any claim against AXO America, Inc. for the use of the Uploaded Content or your name, likeness and/or voice. You agree to indemnify and hold AXO America, Inc., its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, including, but not limited to, SponsorHouse, Inc., and any of their employees (the " AXO America, Inc. Indemnities"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the ‘AXO America, Inc. Indemnities due to or arising out of the Uploaded Content, or your conduct in creating the Uploaded Content or otherwise in connection with the Contest, including but not limited to claims for trademark infringement, copyright infringement, violation of an individual’s right of publicity or right of privacy; or defamation. You further agree to release the AXO America, Inc. Indemnities from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of AXO America, Inc. infringes your rights with regard to any elements, characters or ideas contained in any Uploaded Content.
Selection of Contest Winner
One winner will be chosen at the completion of the contest. Each photo will be submitted to a panel of judges who will determine the best overall photo. The winner will receive the Grand Prize. Estimated value for the prize is $500. The winner shall be notified by the 15th day of the month following the conclusion of the contest. Each winner will be notified by mail, e-mail or telephone within 3 days of the determination. Any prize or prize notification returned to AXO America, Inc. as undeliverable will result in the awarding of that prize to an alternate winner. Except as required by law, AXO America, Inc. will not share entrant information with any third parties. AXO America, Inc. may contact you in the future with offers we feel may be of interest and by entering the Contest, you expressly consent to receiving such communications. The Contest is governed by laws of United States. Any claims relating to this Contest must be resolved in the United States. For a list of Contest winners, send a self-addressed envelope to AXO America, Inc. at the address below between 07/15/2009 and 08/15/2009. All taxes are the responsibility of the winner and the winner agrees to supply AXO America, Inc. with his/her social security number prior to being awarded a prize. Prizes are non-transferable or assignable, no cash will be awarded. AXO America, Inc. reserves the right, in its sole discretion, to conduct background checks on the winners to ensure that the use of any such person in advertising campaigns or publicity will not bring AXO America, Inc. or any of the Contest participants into scandal, ridicule, contempt, public disrepute, or reflect unfavorably on the Contest and AXO America, Inc..
